ORDINANCE NO. BL2011-3

An ordinance amending Chapter 15.64 of the Metropolitan Code to allow recreational athletic fields and associated structures to be constructed within the floodway under certain conditions.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 15.64.170 of the Metropolitan Code is hereby amended by amending subsection B. by adding the following provision at the end thereof:

“f. Athletic fields used for recreational purposes, including facilities associated with the recreational athletic fields such as dugouts, bleachers, concession stands, storage buildings, and other similar structures or facilities.”

Section 2. Section 15.64.170 of the Metropolitan Code is hereby amended by adding the following new subsection C.:

“C. The Metropolitan Stormwater Management Committee shall have the authority to determine whether a structure proposed pursuant to subsection B. of this section will have no adverse impact.”

Section 3. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

I move to amend Ordinance No. BL2011-3 by deleting Section 2 in its entirety and renumbering the existing Section 3 as Section 2.
