ORDINANCE NO. BL2011-969
An ordinance approving a lease agreement with the State of Tennessee, Department of Transportation in relation to the Gateway to Heritage Phase IB streetscape improvements (Proposal No. 2011M-014PR-001).
WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”) has approved plans for the Gateway to Heritage Project, consisting of Phase IA and IB, for streetscape improvements along sections of Jefferson Street; and,
WHEREAS, construction for Phase IA of the Gateway to Heritage Project was principally funded by a grant from the State of Tennessee, Department of Transportation (“TDOT”), Pin No. 103419, pursuant to Resolution No. RS2008-515, and maintenance for Phase IA being provided by TSU, Meharry, and JUMP pursuant to an agreement under Ordinance No. BL2011-905; and,
WHEREAS, now Tennessee State University has committed to provide HUD funds by and through the Metropolitan Development and Housing Authority to assist in constructing the Gateway to Heritage Phase IB streetscape improvements, consisting largely of the Heritage Plaza under Interstate I-40 along Jefferson Street; and,
WHEREAS, TDOT has offered to lease to the Metropolitan Government of Nashville and Davidson County, by and through the Department of Public Works as custodians of the public right-of-way, the State right-of-way needed for Phase IB construction and operation; and,
WHEREAS, pursuant to the terms of the lease agreement with TDOT, attached hereto as Exhibit A, The Metropolitan Government of Nashville and Davidson County would accept the lease to install and operate the streetscape landscaping and pedestrian access related to Phase IB on the State property; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this lease agreement be approved.
NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The lease agreement between The Metropolitan Government of Nashville and Davidson County and TDOT, attached hereto and incorporated herein as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute said agreement.
Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.
Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
