ORDINANCE NO. BL2011-966

An ordinance approving a lease agreement with the State of Tennessee, Department of Transportation in relation to construction and maintenance of a berm (Proposal No. 2011M-016PR-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County is currently working with the United States Corps of Engineers to construct a berm along or under I-65 to assist in the prevention of flooding; and,

WHEREAS, portions of the berm are to be constructed on property owned by the State of Tennessee; and,

WHEREAS, the State has offered to lease, pursuant to the terms of the lease agreement attached hereto as Exhibit A, to the Metropolitan Government of Nashville and Davidson County, by and through the Department of Water Services, the State right-of-way to construct the berm and maintain vegetation; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that thislease agreement be approved.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The lease agreement between The Metropolitan Government of Nashville and Davidson County and TDOT, attached hereto and incorporated herein as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
