ORDINANCE NO. BL2011-965

An ordinance approving an agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Department of Public Works, and Creative Outdoor Advertising of America to provide a public right-of-way recycling and waste collection system within the USD with sponsorship rights, and authorizing the execution of the same.

WHEREAS, Creative Outdoor Advertising of America (“COA”) has received an intent to award letter following its proposal for a public right-of-way recycling and waste collection system in response to the Purchasing Department’s Request for Proposal Number 11.080; and,

WHEREAS, the final award of this purchasing contract is conditioned upon the approval of the Metropolitan Council; and,

WHEREAS, COA would supply, install, and maintain trash and recycling containers for a fully serviced public right-of-way waste and recycling program in the urban services district at no cost to the Metropolitan Government of Nashville and Davidson County; and,

WHEREAS, COA would receive sponsorship rights for advertising on identified waste and recycling containers with the Department of Public Works receiving no less than 2.5% of all gross advertising revenues; and,

WHEREAS, the implementation of this public right-of-way waste and recycling program will convert litter containers to dual waste and recycling receptacles and improve recycling and local environmental efforts in the Metropolitan Government area; and,

WHEREAS, the agreement will be to the benefit of the citizens of The Metropolitan Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: The agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Department of Public Works, and Creative Outdoor Advertising of America to provide a public right-of-way recycling and waste collection system within the USD with sponsorship rights, a copy of which is attached hereto and incorporated herein, is hereby approved and the Director of the Department of Public Works is authorized to execute the same.

SECTION 2: That any amendments, renewals or extensions of the terms of the agreement shall be approved as provided in the agreement.

SECTION 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
