ORDINANCE NO. BL2011-960

An ordinance abandoning an existing drainage easement on a portion of property located at 830 Gale Lane, west of Franklin Pike (Proposal No. 2011M-004ES-001).

WHEREAS, the existing drainage easement on a portion of property located at 830 Gale Park, west of Franklin Pike, on record in the Department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2011M-004ES-001 on May 24, 2011 for abandonment of said public drainage easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the public drainage easement located at 830 Gale Park, as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
