ORDINANCE NO. BL2011-958
An ordinance abandoning 9 water service lines and 407 linear feet of a 10 inch sanitary sewer line, 279 linear feet of a 15 inch sanitary sewer line, 252 linear feet of a 18 inch sanitary sewer line, and 89 linear feet of an 8 inch sanitary sewer line, and accepting 384 linear feet of a 12 inch sanitary sewer and easement, on properties located at Rosa Parks Boulevard, Commerce Street, 7th Avenue North, and Church Street, in connection to Project 10-SL-149, and authorizing the execution of documents to carry out said transaction (Proposal No. 2011M-005ES-001).
WHEREAS, the 9 water service lines and 407 linear feet of a 10 inch sanitary sewer line, 279 linear feet of a 15 inch sanitary sewer line, 252 linear feet of a 18 inch sanitary sewer line, and 89 linear feet of an 8 inch sanitary sewer line, on properties located at Rosa Parks Boulevard, Commerce Street, 7th Avenue North, and Church Street, on record in the Department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,
WHEREAS, 384 linear feet of a 12 inch sanitary sewer line, on record in the Department of Water and Sewerage Services and incorporated herein by reference, has been constructed and is ready for acceptance; and,
WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2011M-005ES-001 on May 31, 2011 for abandonment and relocation of said easement and sanitary sewer line.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan Government hereby abandons the 9 water service lines and 407 linear feet of a 10 inch sanitary sewer line, 279 linear feet of a 15 inch sanitary sewer line, 252 linear feet of a 18 inch sanitary sewer line, and 89 linear feet of an 8 inch sanitary sewer line, and accepts the 384 linear feet of a 12 inch sanitary sewer and easement, on properties located at Rosa Parks Boulevard, Commerce Street, 7th Avenue North, and Church Street, in connection to Project 10-SL-149, as indicated on Exhibit 1 hereto.
Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
