ORDINANCE NO. BL2011-957

An ordinance amending Title 15 of the Metropolitan Code pertaining to the metering of water consumption and sewerage use by commercial class customers of the Department of Water and Sewerage Services.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 15.32.010 of the Metropolitan Code is hereby amended by adding the following provisions at the end of subsection B.:

“The director shall establish each customer’s classification with reference to the customer’s water usage in cubic feet per month as measured by the customer’s main meter, or the meter closest in line to the water service connection if the customer has a series of meters. A customer’s classification so established shall apply for both water and sewerage rates.”

Section 2. That Section 15.48.010 of the Metropolitan Code is hereby amended by adding the following two new paragraphs:

“Commercial class customers shall be assessed water usage charges based on the readings of the customer’s main meter or meter closest in line to the water service connection if the customer has a series of meters. For billing purposes, where a battery of meters are equally proximate to the customer’s water service connection, then the consumption as registered by the battery of meters shall be combined and charged for at such rate as though the water was supplied through a single meter.

Commercial class customers shall be assessed sewerage charges based on the amount of water flowing through their sewer service connection as measured by the meter or meters closest in line to the sewer connection if customer has a series of meters or, if no such series of meters is installed, by the customer’s main or initial meter. For billing purposes, where a battery of meters are equally proximate to the customer’s sewer service connection, then the discharge as registered by the battery of meters shall be combined and charged for at such rate as though the water was discharged through a single meter.”

Section 3. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
