ORDINANCE NO. BL2011-952

An Ordinance amending Chapter 5.10 of the Metropolitan Code to allow public art funds to be used for the commissioning and installation of statues, memorials, and monuments.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 5.10.010 of the Metropolitan Code is hereby amended by adding the following provision at the end of the definition of “public art project”:

“Public art project” also includes the commissioning and installation of statues, memorials, and monuments to honor, recognize, or commemorate a historic place or event, or to honor a person of historical significance.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2011-952 by renumbering the existing Section 2 as Section 3, and by adding the following new Section 2:

Section 2. Chapter 5.10 of the Metropolitan Code is hereby amended by adding the following new Section 5.10.040:

5.10.040 Statues, memorials, and monuments – Consultation with historical commission.

Prior to the commissioning of a statue, memorial, or monument to honor, recognize, or commemorate a historic person, place, or event, the arts commission shall consult with the metropolitan historical commission in keeping with the historical commission’s duties pursuant to section 2.128.060 of the metropolitan code. After consultation with the historical commission, the arts commission shall have the final decision making authority regarding such statue, memorial, or monument using public art funds.
