ORDINANCE NO. BL2011-946

An ordinance authorizing the Director of Public Property, or his designee, to accept, execute and record a quitclaim deed from Academy Square, Inc. to The Metropolitan Government for a certain parcel of property and execute and convey a quitclaim deed from The Metropolitan Government to Academy Square, Inc. for an adjacent parcel of property (Proposal No. 2011M-008PR-001).

Whereas, pursuant to the terms of the quitclaim deeds attached as Exhibits A and B to this ordinance, the Metropolitan Government has agreed to transfer to Academy Square, Inc. all the interest it may possess in a parcel of property (“Property A”) therein described and as shown in the attachments to the deeds, and Academy Square, Inc. has agreed to transfer to the Metropolitan Government all the interest it may possess in an adjacent parcel of property (“Property B”); and,

Whereas, these quitclaim deeds are part of a settlement agreement between the parties in order to resolve a dispute concerning the property line between property owned by the Metropolitan Government and property owned by Academy Square, Inc.; and,

Whereas, the citizens of Nashville and Davidson County will benefit through the actions contemplated herein.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Director of Public Property, or his designee, is authorized to execute the quitclaim deed attached as Exhibit A conveying such interest as the Metropolitan Government may have in the area shown and described in Collective Exhibit 1.

Section 2. That the Director of Public Property, or his designee, is authorized to accept the property in the quitclaim deed in substantially similar form to the attached Exhibit B, conveying such interest as Academy Square, Inc. may have in the area described in Collective Exhibit 2.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
