ORDINANCE NO. BL2011-942

An ordinance approving a utility agreement between The Metropolitan Government of Nashville and Davidson County and BellSouth Telecommunications, Inc. d/b/a AT&T Tennessee in relation to construction of the Gateway Boulevard extension.

WHEREAS, the Metropolitan Government of Nashville and Davidson County accepted a grant from the State of Tennessee, Department of Transportation (“TDOT”), Pin No. 113441.00, by Resolution No. RS2010-1106, which provides funds for the Gateway Boulevard Extension from 4th Avenue South to 8th Avenue South, including streetscape and a roundabout construction; and,

WHEREAS, the Metropolitan Government plans to construct the Gateway Boulevard extension Project and for said project to be constructed it will be necessary for BellSouth Telecommunications, Inc. d/b/a AT&T Tennessee to relocate certain of its facilities and/or place a new conduit and manhole in Gateway Boulevard - 8th Avenue South - Lafayette Street Roundabout; and,

WHEREAS, BellSouth Telecommunications, Inc. d/b/a AT&T Tennessee has furnished the Metropolitan Government with an estimate and plans showing the cost and manner of relocating and/or placing a new conduit and manhole in the Roundabout; and,

WHEREAS, the parties want to enter into an agreement to provide for relocation and /or placing of a new conduit and manhole in conjunction with the rights-of- way construction project, and the BellSouth Telecommunications, Inc. d/b/a AT&T Tennessee has requested Metro to undertake the hereafter described utility relocation and /or construction work within right-of-way construction contract; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The utility agreement between The Metropolitan Government of Nashville and Davidson County and BellSouth Telecommunications, Inc. d/b/a AT&T Tennessee, attached hereto and incorporated herein as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute said document.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
