ORDINANCE NO. BL2011-919

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to accept a donation of real property being all of Parcel 319 and a portion of Parcel 174 on Tax Map 164, land to be donated for the use and benefit of the Metropolitan Board of Education (Proposal No. 2011M-011PR-001).

WHEREAS, Belz/Becker-Lewis-Shlenker Properties, owners, desires to donate approximately 11.07 acres of land, which is all of Parcel 319 and a portion of Parcel 174, Davidson County Tax Map 164, identified by Exhibit A, to the Metropolitan Government for the use and benefit of the Metropolitan Board of Education; and,

WHEREAS, in 2003 the Metropolitan Council enacted ordinance BL2003-1383 requiring that no final plat for development on the site could be approved until a school site is offered to the Metropolitan Board of Education in compliance with Section 17.16.040 of the Metropolitan Code and that such school be an elementary school with a capacity of 500 students, that number being proportional to the approved development’s student generation potential; and,

WHEREAS, the herein described donation of this land fulfills the condition of council bill BL2003-1383 to rezone the Starwood Amphitheatre property; and,

WHEREAS, it is in the best interest of the Metropolitan Government to accept the donated subject property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Metropolitan Council hereby authorizes the acceptance of the donated subject property, as identified by Exhibit A,attached hereto and incorporated herein by reference, for the use and benefit of the Metropolitan Board of Education.

Section 2. The Director of Public Property Administration, or his designee is hereby authorized to accept said property title, in the form of a warranty deed, attached hereto as Exhibit B.

Section 3. This Ordinance shall take effect from and after its final passage, the welfare of The
Metropolitan Government of Nashville and Davidson requiring it.
