ORDINANCE NO. BL2011-915

An ordinance approving a lease between The Metropolitan Government of Nashville and Davidson County and the Center for Charter School Excellence in Tennessee for the use of improved property at 217 South 10th Street (Proposal No. 2011M-009PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County owns the improved property at 217 South 10th Street, which formerly housed the East Head Start Center and is currently vacant, and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County has negotiated a lease agreement with The Center for Charter School Excellence in Tennessee for an initial term of five (5) years, with an option to extend the lease agreement for an additional five-year term, a copy of which is attached hereto; and,

WHEREAS, approval of this lease agreement was granted by the Metropolitan Planning Commission on April 29, 2011; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this lease agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the lease agreement entered into between The Metropolitan Government of Nashville and Davidson County and The Center for Charter School Excellence in Tennessee, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2: That any new amendments to this lease agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
