ORDINANCE NO. BL2011-905

An ordinance approving a maintenance and license agreement between the Metropolitan Government of Nashville and Davidson County and Tennessee State University, Meharry Medical College, and Jefferson Street United Merchants Partnership in relation to maintenance of streetscape improvements along I-40 at Jefferson Street and 28th Avenue North.

WHEREAS, the Metropolitan Government of Nashville and Davidson County accepted a grant from the State of Tennessee, Department of Transportation (“TDOT”), Pin No. 103419, by Resolution No. RS2008-515, which provides funds for improvements, including landscaping, directional signage, and an irrigation system, to off ramps along I-40 at Jefferson Street and 28th Avenue North; and,

WHEREAS, the grant requires the Metropolitan Government, through the Department of Public Works, to maintain and operate of all project improvements; and,

WHEREAS, as part of the grant agreement, the Metropolitan Government of Nashville and Davidson County plans, subject to proper approvals including that of the Metropolitan Council, to enter into an encroachment or license agreement with the State of Tennessee, Department of Transportation, regarding the right to enter, use, and maintain the area containing the streetscape improvements at the 1-40 exits of 28th Avenue and Jefferson Street in Davidson County; and,

WHEREAS, Tennessee State University (“TSU”), Meharry Medical College (Meharry), and Jefferson Street United Merchants Partnership (“JUMP”) wish to participate in the maintenance and landscaping of the right-of-way project improvements; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The maintenance and license agreement between The Metropolitan Government of Nashville and Davidson County and TSU, Meharry, and JUMP, attached hereto and incorporated herein as Exhibit A, is hereby approved.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
