ORDINANCE NO. BL2011-864

An Ordinance amending Section 2.78.010 of the Metropolitan Code to modify the provision pertaining to the selection of an operator for the State Fair.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 2.78.010 of the Metropolitan Code is hereby amended by deleting the provisions of subsection A. and substituting with the following new subsection A.:

“A. The Fair Board shall negotiate with a suitable entity or entities to hold a fair in 2011 and 2012 to be called “The Tennessee State Fair” on the existing Tennessee State Fairgrounds site located in Council District 17. In considering whether an entity is suitable, the Fair Board shall ensure that the entity is willing to commit to honoring the traditional State Fair exhibits specified in Chapter No. 515 of the 1923 Acts of Tennessee, which shall include, but not be limited to, agricultural, mineral, livestock, commercial, industrial, and educational exhibits. Of those entities determined by the Fair Board to be suitable, the Fair Board shall award the contract to the entity or entities that would generate the greatest level of income for the Fair Board. Any agreement negotiated between the Fair Board and such suitable entity or entities shall provide that the Metropolitan Government shall not be liable for any financial losses associated with the operation of the State Fair.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
