ORDINANCE NO. BL2011-842
An ordinance approving an amendment to the lease between the Metropolitan Government and Square Investment Holdings, LP for space in the Washington Square Building located at 222 Second Avenue North (Proposal No. 2011M-002PR-001).
WHEREAS, the Metropolitan Government and Square Investment Holdings, LP (“SIH”) previously entered into a lease agreement for office space in the Washington Square Building (the “Building”), located at 222 Second Avenue North in Nashville, which lease was approved by Ordinance BL2008-226; and,
WHEREAS, the Office of the District Attorney for Davidson County needs additional space to house its Juvenile Court staff who were displaced after the May 2010 flood; and,
WHEREAS, the Building contains additional space suitable for such offices; and,
WHEREAS, pursuant to the terms of the document (the “Lease”), the parties can amend the Lease to add office space adjacent to its current space when such space becomes available; and,
WHEREAS, pursuant to the terms of the First Lease Amendment, attached hereto, the parties wish to add the available space to the current Lease; and,
WHEREAS, approval of the First Lease Amendment is in the best interests of the Metropolitan Government.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: That the First Lease Amendment (Exhibit 1) is hereby approved and the Director of Finance or his designee is authorized to execute it on behalf of the Metropolitan Government.
Section 2: That any future amendments to the Lease Agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.
Section 3: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
