ORDINANCE NO. BL2011-839

An ordinance abandoning all public utility easements in connection with Project 10-WL-61 and 10-SL-133, Brighton Road, and Project No. 10-SL-165 sewer on MBA campus, shown on Map 103-16, Parcels 52, 66, and 29, and authorizing the execution of the documents to carry out said transaction (Proposal No. 2010M-029ES-001).

WHEREAS, substitute ordinance No. BL2010-623 abandoned a portion of Brighton Road right-of-way but retained all public utility easements; and,

WHEREAS, the water and sewer lines and easement, more particularly described in Project No. 10-WL-61 and 10-SL-133, Brighton Road, and the sewer line from Project No. 10-SL-165 on MBA campus, both on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services, nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2010M-029ES-001 on November 30, 2010 for abandonment of said public utility easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the public utility easements, Project No. 10-WL-61 and 10-SL-133, Brighton Road, and Project No. 10-SL-165, on the MBA campus, shown on Map 103-16, Parcels 52, 66, and 29.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
