ORDINANCE NO. BL2010-823

An ordinance repealing Ordinance No. BL2007-1544, as amended, to rescind the Metropolitan Council’s approval of the lease agreement between the Metropolitan Government and Belmont University concerning the development and shared use of Rose Park.

WHEREAS, on August 21, 2007, the Metropolitan Council enacted Ordinance No. BL2007-1544, as amended, approving a lease agreement between the Metropolitan Government and Belmont University concerning the development and shared use of Rose Park; and

WHEREAS, based on actions recently taken by Belmont University concerning the termination of the women’s soccer coach, presumably as a result of her sexual orientation, the Metropolitan Council no longer desires for the Metropolitan Government to participate with Belmont University in the development and shared use of Rose Park unless and until Belmont University formally amends its official bylaws and policies to prohibit discrimination of all forms, including sexual orientation.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2007-1544, as amended, is hereby repealed in its entirety and the Metropolitan County Council hereby rescinds its approval of the Property Improvement and Lease Agreement for the development and shared use of Rose Park by the Metropolitan Government and Belmont University.

Section 2. The Metropolitan Clerk is directed to send a copy of this ordinance to Belmont University President Bob Fisher and to each member of the Metropolitan Board of Parks and Recreation.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
