ORDINANCE NO. BL2010-816

An ordinance authorizing the acceptance or acquisition of easements by negotiation or condemnation for the purpose of construction, operation, maintenance, repair, replacement and inspection of a proposed streambank stabilization project on the Cumberland River adjacent to Waterford subdivision (Proposal No. 2010M-032ES-001).

WHEREAS, the Metropolitan Government has received confirmation of funding from the Natural Resource Conservation Service, a division of the United States Department of Agriculture, to survey, design and construc a streambank stabilization project on the Cumberland River adjacent to Waterford subdivision; and,

WHEREAS, it is in the public interest that the easements be acquired for the construction, operation, maintenance, repair, replacement and inspection of a proposed streambank stabilization project.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to acquire by negotiation or condemnation the easements, including construction easements, for use in public projects of the Metropolitan Government, initially for purposes of construction of a proposed streambank stabilization project, the same being for a public purpose and the public convenience requiring it.

Section 2. The easements to be acquired are listed on the plans for the project, on file with the Department of Water and Sewerage Services and attached hereto as Exhibit A.

Section 3. The Director of Public Property Administration is hereby authorized and directed, if necessary, to execute the necessary documents to acquire by negotiation or condemnation the interests in real property described herein in the name of The Metropolitan Government of Nashville and Davidson County for use in public projects of the Metropolitan Government.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
