ORDINANCE NO. BL2010-814

An ordinance approving an agreement between Vanderbilt University and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, for the installation of and access to wind and solar power generating facilities on Love Circle Reservoir property in Davidson County, Tennessee and authorizing the execution of same.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, provides water, sewerage, and stormwater services in Davidson County, Tennessee and operates a reservoir at Love Circle with sufficient space to house wind and solar power generating facilities; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County and Vanderbilt University are interested in the feasibility of alternative energy power generating facilities to provide power to communities within the area of the Metropolitan Government; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County proposes to participate with Vanderbilt University in constructing pilot wind and solar based power generating facilities at the Love Circle Reservoir property, whereby the Metropolitan Government provides funds for the construction of and is responsible for maintaining and operating the facilities, and is the sole beneficiary of the power and/or proceeds developed by the facilities. Vanderbilt University agrees to oversee the plans and construction of the facilities and to conduct research and educational activities at the facilities, as set forth in the agreement attached to this resolution as Exhibit 1.

WHEREAS, it is in the best interest of The Metropolitan Government of Nashville and Davidson County that this agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The agreement between Vanderbilt University and The Metropolitan Government of Nashville and Davidson County for the installation of and access to wind and solar power generating facilities at Love Circle Reservoir, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2: That any amendments, renewals, or extensions of the terms of the agreement shall be approved by Resolution of the Metropolitan Council.

Section 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
