SUBSTITUTE ORDINANCE NO. BL2010-797

An ordinance authorizing the Metropolitan Government to participate with Rogers Group, Inc. to improve public sewer service in Davidson County by constructing the Basswood and Cockrill Bend Trunk Sewer Line Relocation Project No: 10-SL-206.

WHEREAS, pursuant to the terms of the document, attached as Exhibit A, Metropolitan Government of Nashville proposes to improve public sewer service in the Basswood & Cockrill Bend area of Davidson County, Tennessee by constructing a Sewer Relocation Project, No: 10-SL-206; and,

WHEREAS, this Project is deemed to benefit both parties and the general community, and Metropolitan Government of Nashville agrees to pay an amount not to exceed $1,725,000 toward the construction of a new force main.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The participation agreement (Exhibit A) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and Rogers Group, Inc. to improve public sewer services in Davidson County, Tennessee, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

Section 2. That the $1,725,000 from Metropolitan Government of Nashville is available in the Water and Sewer Extension and Replacement Fund No. 47335 to pay the lesser of the actual design, inspection and bid costs or $1,725,000 as a contribution toward the new sewer main.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
