ORDINANCE NO. BL2010-796

An ordinance approving an agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, and CCBCC Operations, LLC, for the purpose of promoting recycling and environmental awareness through a Recycle and Win Program.

WHEREAS, CCBCC Operations, LLC, (“CCBCC”) offers to promote recycling and environmental awareness within the area of the Metropolitan Government, through the development, implementation, and administration of a program known as “Recycle and Win!,” which is more fully described in Exhibit A attached hereto (the “Program”); and,

WHEREAS, the Metropolitan Government of Nashville and Davidson County, Department of Public Works, has, as one of its primary missions, the responsibility for responsible waste management within the Metropolitan Government limits and desires to promote such mission through its participation in the Program; and,

WHEREAS, the agreement requires no matching funds for the development, implementation, and administration of the Recycle and Win Program; and,

WHEREAS, in consideration of the agreement, CCBCC agrees to rent to the Metropolitan Government a vehicle to be driven by designated employees of the Department of Public Works to conduct Metropolitan Government business associated with the Program; and,

WHEREAS, the Metropolitan Government would be responsible for any damage in excess of ordinary wear and tear to the vehicle while in its possession; and,

WHEREAS, the vehicle would be decorated similarly to the depiction attached hereto as Exhibit B; and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that agreement be accepted.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the agreement (Exhibit A) by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, and CCBCC Operations, LLC, for the purpose of promoting recycling and environmental issues through a Recycle and Win Program, a copy of which agreement is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any amendments to this legislation may be processed by resolution.

Section 3. That this ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

By deleting Exhibit A in its entirety and replacing it with the attached Exhibit A.
