ORDINANCE NO. BL2010-795

An ordinance accepting a contribution in an amount not to exceed $200,000 from The Parkes Companies, Inc., for traffic calming and beautification projects in the Annex Avenue and Hillwood neighborhoods, and appropriating said amount to the Department of Public Works.

WHEREAS, Ordinance No. BL2005-623, as amended, approved by the Council on June 7, 2005, made applicable the provisions of a Planned Unit Development District to property located on Charlotte Pike and Annex Avenue to permit the development of 474,484 square feet of retail, restaurant and office use known as the Nashville West development; and

WHEREAS, Section 3 of Ordinance No. BL2005-623, as amended, provided that the developer would deposit $50,000 in escrow to be used for traffic calming and beautification affecting Annex Avenue and $150,000 to be used for traffic calming and beautification within the affected areas of the Hillwood neighborhood; and

WHEREAS, the developer desires to transfer such funds held in escrow to the Metropolitan Department of Public Works so that these traffic calming and beautification projects can be completed.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the contribution not to exceed the amount of Two Hundred Thousand Dollars ($200,000.00) from The Parkes Companies, Inc., pursuant to Ordinance No. BL2005-623, is hereby accepted and said amount is hereby appropriated to the Department of Public Works for traffic calming and beautification improvements in the Annex Avenue and Hillwood neighborhood areas.

Section 2. That future amendments to this ordinance may be approved by a resolution receiving twenty-one (21) affirmative votes.

Section 3. That this Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
