ORDINANCE NO. BL2010-792

An ordinance approving three lease agreements for the lease of space in Hickory Hollow Mall by The Metropolitan Government of Nashville and Davidson County from Hickory Hollow Mall Limited Partnership and Hickory Hollow/SB, LLC (Proposal No. 2010M-013PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County has developed one lease agreement with Hickory Hollow Mall Limited Partnership to permit the Metropolitan Government to utilize space in Hickory Hollow Mall; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County has developed two lease agreements with Hickory Hollow/SB, LLC, to permit the Metropolitan Government to utilize space in Hickory Hollow Mall; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that these three lease agreements be approved.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the lease agreement entered into between The Metropolitan Government of Nashville and Davidson County and the Hickory Hollow Mall Limited Partnership, a copy of which is attached hereto as Exhibit 1 and incorporated herein, is hereby approved and the Metropolitan County Mayor is authorized to execute the same.

Section 2: That the two lease agreements entered into between The Metropolitan Government of Nashville and Davidson County and the Hickory Hollow/SB, LLC, copies of which are collectively attached hereto as Exhibit 2 and incorporated herein, are hereby approved and the Metropolitan County Mayor is authorized to execute the same.

Section 3: That any new amendments to these three lease agreements shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 4: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
