ORDINANCE NO. BL2010-790

An ordinance continuing the current ten percent user surcharge to fund water and sewerage system operations, capital improvements, and debt obligations of the Metropolitan Government related to improvements, alterations and extensions of the water and sewerage systems.

WHEREAS, Ordinance No. 70-1266 authorized the imposition of a ten percent sewer user surcharge on customers of the Metropolitan Department of Water and Sewerage Services to permit the Metropolitan Government to participate in a sewage treatment works loan program (the “TWL Program”) administered by the State of Tennessee; and,

WHEREAS, continuing the ten percent surcharge and authorizing its use to fund water and sewerage system operations, capital improvements, and debt obligations other than or in addition to the TWL Program related to improvements, alterations and extensions of the water and sewerage systems is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The ten percent sewer user surcharge enacted by Ordinance No. 70-1266 is hereby continued and its use authorized to fund water and sewerage system operations, capital improvements, and debt obligations other than or in addition to the TWL Program related to improvements, alterations and extensions of the water and sewerage systems.

Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
