ORDINANCE NO. BL2010-787

An ordinance authorizing the exchange of vacant property for the purpose of acquiring land for recreational use by the Metropolitan Government (Proposal No. 2010M-011PR-001).

WHEREAS, the Metropolitan Government of Nashville and Davidson County ("Metro") owns land known as Davidson County Tax Map 092-08-0 Parcel 163.00, also known as William Edmondson Park, 1642 Charlotte Avenue and shown on Exhibit A; and,

WHEREAS, the Metropolitan Development and Housing Agency owns the adjacent and adjoining John Henry Hale Homes (also known as Davidson County Tax Map 092-08-0 Parcel 376.00 and shown on Exhibit A); and,

WHEREAS, the Metropolitan Development and Housing Agency developed and has been maintaining William Edmondson Park since 2007; and,

WHEREAS, the Metropolitan Development and Housing Agency owns a parcel of land known as Davidson County Tax Map 083-10-0 Parcel 321.00 (also known as 1810 Woodland Street and shown on Exhibit B) and has offered the same to the Metropolitan Government in exchange for the park land; and,

WHEREAS, it is in the public interest that land be acquired for use as a public park; and,

WHEREAS, the Metropolitan Board of Parks and Recreation has approved both the disposal of the William Edmondson Park to the Metropolitan Development and Housing Agency and acceptance of the Woodland Street property from the Metropolitan Development and Housing Agency; and,

WHEREAS, the Metropolitan Development and Housing Agency agrees to conserve the William Edmondson Park property for a minimum of 50 years as green space.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Director of Public Property Administration is hereby authorized to exchange the herein described land for use by Metro Parks and Recreation, the same being for a public purpose and the public convenience requiring it.

Section 2. The property to be acquired is shown on Exhibit B, attached hereto and incorporated herein.

Section 3. Any amendment to the described exchange of these properties, for these same purposes, may be authorized by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
