ORDINANCE NO. BL2010-769

An ordinance approving a license agreement between the Metropolitan Nashville Public Schools and the Hickory Hollow Mall Limited Partnership for certain space inside the Hickory Hollow Mall (Proposal No. 2010M-007PR-001).

WHEREAS, the floods of May, 2010, inflicted significant damage to the Opry Mills Mall where the Metropolitan Nashville Public Schools has leased space to conduct the Academy at Opry Mills Education Resource Center, and

WHEREAS, the 2010-2011 school year is beginning making it imperative that this temporary site, convenient to students and sufficient to meet the Academy’s needs, be secured for use during the duration of repairs to the space at Opry Mills, and

WHEREAS, the Hickory Hollow Mall Limited Partnership owns certain real property located at 5252 Hickory Hollow Parkway, Antioch, Tennessee, 37013, commonly known as the Hickory Hollow Mall, and the Metropolitan Government, by and through the Metropolitan Nashville Public Schools has negotiated the attached license agreement, and

WHEREAS, the Metropolitan Nashville Public Schools has determined that the aforesaid property is acceptable and sufficient to its need for a temporary location for the Academy at Opry Mills for the upcoming 2010-2011 school year and the license agreement has been created in the interest of providing a benefit to the school system, its students and the community, and

WHEREAS, the Director of Public Property Administration is authorized to lease real property, subject to the approval of the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The License Agreement between Hickory Hollow Mall Limited Partnership and the Metropolitan Nashville Public Schools for the use of approximately 6,486 sq. ft. of space with MNPS paying only the cost of utilities and HVAC services and no rental fee, and for a term beginning on or about August 1, 2010 and ending on or about May 31, 2011, a copy of which is attached hereto and incorporated herein, and the same is hereby approved.

SECTION 2. That any amendments to this License Agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
