ORDINANCE NO. BL2010-768
An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County by accepting Hoggett Ford Road as a public road (Proposal No. 2010M-009PR-001).
WHEREAS, Hoggett Ford Road is a private road 6,696 feet in length located in Council District 14; and
WHEREAS, Hoggett Ford Road serves a number of residential properties with an average appraised value of $249,343; and
WHEREAS, water service to these residences on Hoggett Ford Road is inadequate, with approximately four to six homes having no access to water service at all; and
WHEREAS, in order for Metro Water Services to consider upgrading the water facilities serving Hoggett Ford Road, it is necessary that the roadway be accepted as a public street; and
WHEREAS, Chapter 13.10 of the Metropolitan Code sets forth criteria for the acceptance of private roads, which include adequate right-of-way width, drainage facilities, pavement standards, and as-built certified plans; and
WHEREAS, although Hoggett Ford Road meets the majority of the criteria set forth in Chapter 13.10, the Council deems it to be in the best interest of the Metropolitan Government of Nashville and Davidson County that Hoggett Ford Road be accepted as public roadway in its present condition.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. Notwithstanding the provisions of Chapter 13.10 of the Metropolitan Code to the contrary, the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. BL2009-603, is hereby amended by accepting Hoggett Ford Road, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, as a public road.
Section 2. That the Director of the Department of Public Works is hereby authorized and directed to cause said change to be made on said Map as set out in Section 1 of this Ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory Ordinance.
Section 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
