ORDINANCE NO. BL2010-766

An ordinance to clarify the status of former employees of the Metropolitan Convention Center Commission.

WHEREAS, Ordinance No. 2010-690 repealed Chapter 2.124 of the Metropolitan Code, thereby abolishing the Metropolitan Convention Center Commission, and transferred the employees (the “Employees”) of the Convention Center Commission to the Department of Finance; and,

WHEREAS, Ordinance No. 2010-690 approved an interlocal agreement (the “Agreement”) between the Metropolitan Government and the Convention Center Authority of the Metropolitan Government of Nashville and Davidson County (the “Authority”) under which, among other things, the Authority assumed responsibility for operation, maintenance and management of the Metropolitan Government’s existing convention center facility and the Employees were assigned and loaned to the Authority; and,

WHEREAS, while employed by the Convention Center Commission, the Employees were not members of the classified service and their transfer to the Department of Finance did not effect any change in their status as non-members.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Former employees of the Convention Center Commission now transferred to the Department of Finance shall continue to hold positions in the non-classified service.

Section 2. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
