ORDINANCE NO. BL2010-763

An ordinance amending Section 11.12.070 of the Metropolitan Code pertaining to noise in certain areas of downtown Nashville.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 11.12.070 of the Metropolitan Code is hereby amended as follows:

1. By deleting the first sentence of subsection A. and substituting with the following:

“A. Except as provided in subsection B. of this section, it shall be unlawful for any person to:”

2. By deleting the first sentence of subsection B. and substituting with the following new subsection B.:

B. The provisions of this subsection B. shall be applicable for properties lying within an area zoned DTC district and properties zoned CS district that are contiguous to those zoned DTC district, provided that the provisions of subsection A. shall apply to Zone 1 and Zone 2 as herein defined. “Zone 1” includes those properties located within the boundaries of Sixth Avenue North to the west, Union Street to the north, Fifth Avenue North to the east, and Church Street to the south. “Zone 2” includes those properties located within the boundaries of Korean Veterans Boulevard to the north, Third Avenue South to the east, Lea Avenue to the south, and Fourth Avenue South to the west.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
