ORDINANCE NO. BL2010-757

An ordinance authorizing the acceptance or acquisition of easements by negotiation or condemnation for the purpose of construction of sidewalks and associated improvements along the west side of Oakwood Avenue between Slaydon Avenue and Bullock Avenue, Proposal No.2010M-026ES-001.

WHEREAS, it is in the public interest that right-of-way easements be acquired for the construction of sidewalks and associated improvements along Oakwood Avenue between Slaydon Avenue and Bullock Avenue; and,

WHEREAS, the Metropolitan Planning Commission has recommended approval of this acquisition, Mandatory Referral Proposal No. 2010M-026ES-001, to the Metropolitan Council.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to acquire by negotiation or condemnation the right-of-way easements and construction easements for use in public projects of the Metropolitan Government, initially for purposes of the Public Works Department project PIN No. 112312.00, Oakwood Avenue Sidewalk Improvements, the same being for a public purpose and the public convenience requiring it.

Section 2. The easements to be acquired are listed on the plans for the project PIN No. 112312.00, Oakwood Avenue Sidewalk Improvements, on file with the Public Works Department and attached hereto as Exhibit A, and located on the property described in Mandatory Referral Proposal No. 2010M-026ES-001 attached hereto as Exhibit B and incorporated herein.

Section 3. The Director of Public Property Administration is hereby authorized and directed, if necessary, to execute the necessary documents to acquire by negotiation or condemnation the interests in real property described herein in the name of The Metropolitan Government of Nashville and Davidson County for use in public projects of the Metropolitan Government.

Section 4. All necessary and incidental costs of the right-of-way easements and construction easements herein authorized to be acquired shall be paid from funds authorized from Fund No. 40009 Bu No. 42409010.

Section 5. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
