SUBSTITUTE ORDINANCE NO. BL2010-756

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in public projects of the Metropolitan Government, initially with relation to Project Number 10-R-1, 28th Avenue / 31st Avenue Connector, from Park Plaza to the south side of the Nashville and Western Railroad tracks (Proposal No. 2010M-008PR-001).

WHEREAS, it is in the public interest that property be acquired to permit the construction or other use of right-of-way within the area designated for the construction of Project No. 10-R-1, 28th/ 31st Avenue Connector; and,
WHEREAS, Project No. 10-R-1, 28th Avenue / 31st Avenue Connector, has been included under Capital Improvements Budget No. 06PW0003.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to acquire by negotiation or condemnation the property interests described in Exhibit A, attached hereto and incorporated herein, for Project No. 10-R-1, the 28th Avenue / 31st Avenue Connector, the same being for a public purpose and the public convenience requiring it.

Section 2. The Director of Public Property Administration is hereby authorized and directed, if necessary, to execute the necessary documents to acquire by negotiation or condemnation the interests in real property described herein in the name of The Metropolitan Government of Nashville and Davidson County for use in public projects of the Metropolitan Government.

Section 3. All necessary and incidental costs of the property herein authorized to be acquired shall be paid from funds authorized from Fund #48009 BU42416010.

Section 4. Acquisition of additional or different properties, for these same purposes, may be approved by resolution.

Section 5. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
