ORDINANCE NO. BL2010-746

An ordinance amending Section 17.16.290 of Title 17 of the Metropolitan Code, Zoning Regulations, to require that a resident of the dwelling on which a residential amateur radio antenna is located possess a current, valid FCC license (Proposal No. 2010Z-016TX-001).

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by amending Section 17.16.290 by adding the following provision at the end of subsection A:

“4. A resident of the property must have a current, valid license from the Federal Communications Commission (FCC) to operate as an amateur radio operator. Proof of such license shall be submitted to the zoning administrator prior to the construction of any antenna on the property. If a license expires without being renewed, the tower must be removed at the property owner’s expense.”

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
