ORDINANCE NO. BL2010-730

An ordinance approving a license agreement between The Metropolitan Government of Nashville and Davidson County and the Tennessee Emergency Management Agency for the use of space on the Cane Ridge communications tower (Proposal No. 2008M - 181).

WHEREAS, The Metropolitan Government of Nashville and Davidson County has developed and erected a series of communications towers throughout the county to facilitate the communications capabilities of emergency services agencies, and

WHEREAS, The Metropolitan Government of Nashville and Davidson County has negotiated a license agreement with the Tennessee Emergency Management Agency to permit TEMA to install and maintain certain communications equipment on Metro’s Cane Ridge Communications Tower for an initial term of ten years, with an option to extend the license agreement for an additional ten-year term, a copy of which is attached hereto; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2008M-181 on October 10, 2008 for approval of said license agreement, and

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this license agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the license agreement entered into between The Metropolitan Government of Nashville and Davidson County and the Tennessee Emergency Management Agency, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2: That any new amendments to this license agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
