ORDINANCE NO. BL2010-723

An ordinance authorizing the Metropolitan Government to participate with John Ring to provide public sewer service in Williamson County to Fountainbrooke, Section 10 Property, Project No. 07-SL-83.

WHEREAS, pursuant to the terms of the document attached as Exhibit A, John Ring (Tennessee Contractors, Inc.) proposes to provide public sewer service in Williamson County, Tennessee to a development known as Fountainbrooke, Section 10, Project No. 07-SL-83; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and,

WHEREAS, this Project is deemed to benefit both parties and the general community, and John Ring agrees to pay an amount not to exceed $36,000.00 for a total of 18 single-family home connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The participation agreement with John Ring, attached hereto as Exhibit A and incorporated herein, to provide public sewer services in Williamson County, Tennessee to a development known as Fountainbrooke, Section 10, Project No. 07-SL-83, is hereby approved, and the Director of Water and Sewerage Services is authorized to execute the same.

Section 2. That the $36,000.00 from John Ring will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No.47335.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
