ORDINANCE NO. BL2010-712

An ordinance abandoning a 10 foot public utility easement in connection with Project 09-WG-0004, 915 Otter Creek Road, shown on Map 146-13, Parcel 001.00 and authorizing the execution of the documents to carry out said transaction (Proposal No. 2009M-013ES-001).

WHEREAS, a 10 foot Public Utility Easement, more particularly described in Project No. 09-WG-0004, 915 Otter Creek Road, on record in the Department of Water and Sewerage Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, the Metropolitan Planning Commission approved this mandatory referral No. 2009M-013ES-001 on February 11, 2009 for abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the Public Utility Easement, shown on Map 146-13, Parcel 001.00, Project No. 09-WG-0004, 915 Otter Creek Road, as indicated on Exhibit 1 hereto.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
