ORDINANCE NO. BL2010-692

An ordinance authorizing the Director of Parks and Recreation to accept, execute and record an agreement for grant of easement in favor of the Metropolitan Government for use in connection with development of the Harpeth River Greenway (Proposal No. 2010M-024ES-001).

Whereas, pursuant to the terms of the agreement attached hereto as Exhibit A to this ordinance, the owners of the parcel of property known as Davidson County Tax Map 156-02-0 Parcel 179.00 have agreed to donate an easement to the Metropolitan Government for use in connection with development of the Harpeth River greenway; and

WHEREAS, the easement will be used to construct, operate and maintain portions of the Harpeth greenway system; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the donated easement,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Director of the Division of Public Property Administration and the Director of Parks and Recreation are authorized to accept, execute and record the easements from the owners of the parcels of property pursuant to the terms of the agreement attached hereto as Exhibit A and incorporated herein.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
