Amendment No. 1
To
Ordinance No. BL2010-685

Madam President:

I move to amend Ordinance No. BL2010-685 by amending the proposed new Code Section 6.74.030 in Section 1 of the Ordinance by deleting subsection A. in its entirety and substituting with the following new subsection A.:

“A. An application for a certificate of public convenience and necessity shall be filed with the MTLC for each classification of service to be provided. Forms will be provided by the commission and payment of a nonrefundable fee will be charged. The amount of the application fee shall be established by the MTLC and approved by the Metropolitan Council by resolution.”

Amendment No. 2
To
Ordinance No. BL2010-685

Madam President:

I move to amend Ordinance No. BL2010-685 by amending Section 1 as follows:

I. By amending the proposed new Code Section 6.74.025 by deleting the phrase, “The MTLC may set a minimum charge for livery service in accordance with commission rules”, wherein it appears in subsection D.1.c., and substituting with the phrase, “The fare charged per hour or for flat rate transportation between specific points shall be a minimum of fifty (50) dollars.”

II. By amending the proposed new Code Section 6.74.320 by:
1. Deleting subsection B. in its entirety and re-lettering the remaining subsections accordingly; and
2. Deleting subsection A. in its entirety and substituting with the following new subsection A:

“A. Livery services and any other passenger vehicle for hire services restricted to pre-arranged services must present contracts (trip tickets) for transportation services. Passenger vehicle for hire services operating by pre-arrangement shall obtain written or electronic contracts (trip tickets) for services at least fifteen minutes (15) in advance of the scheduled pickup time. These contracts must include all of the following:
1. Date and time the arrangement was made;
2. Name of passenger;
3. Date and time passenger is to be picked up. If the contract is for service originating at the airport, this will include the airline name, flight number, and the scheduled date and time of arrival;
4. Point of origin; and
5. Name of certificate holder to provide the service.”

To

Madam President:

I move to amend Ordinance No. BL2010-685, as amended, by amending Section 1 as follows:

I. By amending the proposed new Code Section 6.74.025 by deleting the sentence, “The fare charged per hour or for flat rate transportation between specific points shall be a minimum of fifty (50) dollars”, wherein it appears in subsection D.1.c.;

and

By substituting with the following two new sentences:

“The fare charged per hour or for flat rate transportation between specific points shall be a minimum of forty-five (45) dollars inclusive of any and all discounts and exclusive of gratuities or other added rates, fees or charges. The only exception to this minimum charge shall be fully ‘comped’, or free trips, provided solely at the expense of the livery service.”

II. By amending the proposed new Code Section 6.74.320 by deleting subsection A. in its entirety and substituting with the following new subsection A:

“A. Livery services and any other passenger vehicle for hire services restricted to pre-arranged services must present contracts (trip tickets) for transportation services. Passenger vehicle for hire services operating by pre-arrangement shall obtain written or electronic contracts (trip tickets) for services in advance of the scheduled pickup time. These contracts must include all of the following:
1. Date and time the arrangement was made;
2. Name of passenger;
3. Date and time passenger is to be picked up. If the contract is for service originating at the airport, this will include the airline name, flight number, and the scheduled date and time of arrival;
