ORDINANCE NO. BL2010-680

An ordinance approving a license agreement between Vanderbilt University Medical Center and The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Farmers’ Market, for certain real property located at 201 25th Avenue South, Nashville, Tennessee, 37240, commonly known as the courtyard between Langford Auditorium and Vanderbilt University Medical Center, Nashville, Tennessee.

WHEREAS, Vanderbilt University Medical Center owns certain real property located at 201 25th Avenue South, Nashville, Tennessee, 37240, commonly known as the courtyard between Langford Auditorium and Vanderbilt University Medical Center, Nashville, Tennessee; and,

WHEREAS, Vanderbilt University Medical Center and the Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Farmers’ Market, have negotiated the attached license agreement; and,

WHEREAS, the Metropolitan Government has determined that the aforesaid property is needed to provide space for the Nashville Farmers’ Market and the license agreement has been created in the interest of providing a benefit to the community, with no monetary fee owed to Vanderbilt University Medical Center by the Farmers’ Market for use of said space; and,

WHEREAS, the Director of Public Property Administration is authorized to lease real property, subject to the approval of the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The license agreement between Vanderbilt University Medical Center and The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Farmers’ Market, for rental of space in an amount not to exceed $0.00 and for a term beginning on or about May 27, 2010 and ending on or about October 28, 2010, a copy of which is attached hereto and incorporated herein, and the same is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any amendments to this License Agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
