ORDINANCE NO. BL2010-674

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the existing Green Hills Urban Design Overlay District to modify variations to the conventional standards of the underlying base zoning, located along Hillsboro Pike, Hillsboro Drive, Hillsboro Circle, Hobbs Road, Warfield Drive, Richard Jones Road, Bandywood Drive, and Abbott Martin Road (107.87 acres) classified SCR, all of which is more particularly described herein, (Proposal No. 2002UD-001-001).

WHEREAS Title 17 of the Metropolitan Code of Laws allows certain standards that apply to zoning districts to be varied from by design guidelines adopted simultaneously with the application of an urban design overlay district; and

WHEREAS the Green Hills Urban Design Overlay District was applied by Ordinance No. BL2002-1083 and amended by Ordinance No. BL2008-362 and BL2007-1425 to properties in Green Hills along Hillsboro Circle, Bandywood Drive, Hillsboro Drive, Hobbs Road, Warfield Drive, Hillsboro Pike, Abbott Martin Road, and Richard Jones Road; and

WHEREAS, to ensure that the intended design objectives for signage, building form, massing, and character within the Green Hills Urban Design Overlay district are met.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By amending the existing Green Hills Urban Design Overlay District to modify variations to the conventional standards of the underlying base zoning as provided in the attached Exhibit A that was considered by the Planning Commission and on file with the Metropolitan Planning Department, which is made a part of this Ordinance as though copied herein, for property located along Hillsboro Pike, Hillsboro Drive, Hillsboro Circle, Hobbs Road, Warfield Drive, Richard Jones Road, Bandywood Drive, and Abbott Martin Road (107.87 acres) classified SCR, as being various Property Parcel Nos. various as designated on Maps 117-14, 117-15, 131-02, 131-02-B of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet Nos. 117 and 131 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
