ORDINANCE NO. BL2010-653

An ordinance authorizing the Metropolitan Government to participate with Regent Highpoint LLC to provide public sewer service in Davidson County to Project No. 08-SL-58.

WHEREAS, pursuant to the terms of the document, attached as Exhibit A, Regent Highpoint LLC proposes to provide public sewer service in Davidson County, Tennessee to a development known as High Point, Project No. 08-SL-58; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer, Project No. 98-SG-13, anticipating participation from developers at $2,000 per connection towards the cost of the Project; and,

WHEREAS, this Project is deemed to benefit both parties and the general community, and Regent Highpoint LLC agrees to pay an amount not to exceed $192,000 for 96 units of sewer capacity.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The participation agreement (Exhibit A) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, and Regent Highpoint LLC to provide public sewer services in Davidson County, Tennessee, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

Section 2. That the $192,000 from Regent Highpoint LLC be deposited as a contribution-in-aid of construction in the Water and Sewer Extension and Replacement Fund No. 47335.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
