ORDINANCE NO. BL2010-650

An Ordinance amending Chapters 12.44 and 13.40 of the Metropolitan Code to provide notice to disabled drivers of the state law prohibition on parking charges.

WHEREAS, Tennessee Code Annotated § 55-21-105 provides that no state agency, county, city, town or other municipality or any agency thereof shall exact any fee for parking on any street or highway or in any metered parking space or in parking lots municipally owned or leased, or both municipally owned and leased, or a parking place owned or leased, or both owned and leased, by a municipal parking utility or authority to any person with a valid disabled driver license place or placard; and

WHEREAS, it is appropriate that the Metropolitan Government and the Metropolitan Nashville Airport Authority publicize the applicability of this state law for the benefit of the disabled citizens of Metropolitan Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 12.44 of the Metropolitan Code is hereby amended by adding the following new Section 12.44.070:

12.44.070 Disabled driver parking in parking meter zones – notice.

The department of public works shall either post appropriate signage within parking meter zones or include a statement on each parking meter informing drivers that, pursuant to T.C.A. § 55-21-105, no parking meter fee is required for vehicles with a valid disabled driver license plate or placard.

Section 2. That Chapter 13.40 of the Metropolitan Code is hereby amended by adding the following new Section 13.40.070:

13.40.070 Disabled driver parking in lots owned by the metropolitan government.

The department of public works shall post signs at the entrances to all parking garages owned by the metropolitan government informing drivers that, pursuant to T.C.A. § 55-21-105, no parking fee is charged for vehicles with a valid disabled driver license plate or placard.

Section 3. The Metropolitan Clerk is directed to send a copy of this Ordinance to each member of the Metropolitan Nashville Airport Authority.

Section 4. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
