ORDINANCE NO. BL2010-625

An ordinance authorizing the acceptance of certain easements for stormwater projects located at 2855 Logan Street, 2050 Lucas Lane, Lucas Lane, 1st Avenue, North, 1st Avenue, North, 2nd Avenue, North, 1512 2nd Avenue, North, 234 B Davenport Drive, 3183 Hamilton Church Road, Century Boulevard, Tennessee, 1318 Baptist World Center Drive, 1715 Broadway, 4200 Kenilwood Drive, 7102 Highway 70 South, 1007 Murfreesboro Pike, 331 Great Circle Road, 201 North 8th Street, 714 Ramsey Street, 2300 Patterson Street, 3822 Cleghorn Avenue, 2126 Abbott Martin Road, 5144 Hickory Hollow Parkway, 19 Hart Street, 6604 Charlotte Pike, and 100 Airpark Center East.

WHEREAS, multiple easements necessary for the Metropolitan Government to carry out various stormwater projects (the “Projects”) have been executed by the owners of the affected properties and offered to the Metropolitan Government of Nashville and Davidson County; and,

WHEREAS, the easements are listed in Exhibit A hereto and further described in the Metropolitan Water and Sewerage Services Department’s plans on file for the Projects; and,

WHEREAS, the easements are more particularly described in the documents collectively attached as Exhibit B to this ordinance; and,

WHEREAS, acceptance of the easements is in the interest of the citizens of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept from the respective property owners the easements listed in Exhibit A and shown in Exhibit B.

Section 2. The easements shall be filed in the Office of the Register of Deeds after acceptance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
