ORDINANCE NO. BL2010-624

An ordinance abandoning a 10 foot Public Utility Drainage Easement in connection with Project 009-AB-0002, Forest Acres Abandonment, shown on Map 172, Parcel 133.00 and authorizing the execution of the documents to carry out said abandonment (Proposal No. 2009M-083ES-001).

WHEREAS, a 10 nch existing public utility drainage easement, more particularly described in Project No. 09-AB-0002, Forest Acres Abandonment, on record in the department of Water and Sewerage Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewerage Services, nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2009M-083ES-001 on September 14, 2009 for abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government hereby abandons the public utility drainage easement, shown on Map 172, Parcel 133.00, Project No. 09-AB-0002, Forest Acres Abandonment.

Section 2. The Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
