ORDINANCE NO. BL2010-615

An ordinance authorizing the assumption and takeover by the Metropolitan Government of Nashville and Davidson County of all public functions, rights, duties, property, assets, and liabilities connected with Madison Suburban Utility District and assuming service jurisdiction.

WHEREAS, T.C.A. Section 7-3-302 authorizes any metropolitan government created and established pursuant to Title 7 of the Tennessee Code Annotated to assume and take over all the public functions, rights, duties, property, assets, and liabilities of any utility district, sanitary district, school district, or other public service district, all of whose public functions, services and duties are performed within the geographical jurisdiction of such metropolitan government; and

WHEREAS, it is considered to be in the public interest to have uniform consolidated water utilities throughout the Metropolitan Government’s territorial jurisdiction.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Department of Water and Sewerage Services is hereby authorized and directed to assume and take over all functions, rights, duties, property, assets, and liabilities connected with the water distribution reservoirs and pumping facilities of the Madison Suburban Utility District. The Metropolitan Council expressly authorizes and ratifies any and all actions taken and/or documents executed by the Metropolitan Mayor and the Director of the Department of Water and Sewerage Services to facilitate the takeover of the Madison Suburban Utility District located in Davidson County in furtherance of the purpose and intent of this Ordinance.

Section 2. Any amendments to this Ordinance may be approved by resolution of the Council receiving twenty-one affirmative votes.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
