ORDINANCE NO. BL2010-612

An Ordinance amending Section 12.40.200 of the Metropolitan Code pertaining to the starting of parked vehicles.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 12.40.200 of the Metropolitan Code is hereby amended by designating the existing provisions as subsection A., and adding the following new subsection B.:

“B. Notwithstanding the provisions of subsection A. of this section to the contrary, it shall be lawful to start a vehicle which is stopped, standing, or parked and let such vehicle remain idling when such vehicle is equipped with a remote starting device and the doors remain locked while unattended.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2010-612 by deleting the provisions of Section 1 and substituting with the following new provisions:

Section 1. That Section 12.40.200 of the Metropolitan Code is hereby amended by designating the existing provisions as subsection A., and adding the following new subsection B:

“B. Notwithstanding the provisions of subsection A. of this section to the contrary, it shall be lawful to start a vehicle and leave it running if the vehicle is parked on private residential property, the doors of the vehicle remain locked, the vehicle cannot be driven without a key in the ignition switch, and there is no key in the ignition switch while the vehicle is unattended.”
