ORDINANCE NO. BL2009-604

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to accept a donation of three tracts of real property located West of Old Hickory Boulevard, in the vicinity of Murfreesboro Road and Hobson Pike, further described as being a portion of Tax Map 175, land to be donated for the use and benefit of the Metropolitan Board of Parks and Recreation (Proposal No. 2009M-023PR-001).

WHEREAS, Old Hickory Commons, LLC, owner, desires to donate approximately 16.14 acres of land, which is a portion of Parcel 16, Tax Map 175, identified by Exhibit A, to the Metropolitan Government for the use and benefit of the Metropolitan Board of Parks and Recreation; and,

WHEREAS, TWD I Partnership, owner, desires to donate two tracts of land, one consisting of approximately 4.15 acres and one consisting of approximately 1.75 acres, both of which are a portion of Parcel 21, Tax Map 175, identified by Exhibits B and C, respectively, to the Metropolitan Government for the use and benefit of the Metropolitan Board of Parks and Recreation; and,

WHEREAS, it is in the best interest of the Metropolitan Government to accept the donated subject property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Metropolitan Council hereby authorizes the acceptance of the donated subject property, as identified by Exhibits A, B and C, attached hereto and incorporated herein by reference, for the use and benefit of the Metropolitan Board of Parks and Recreation.

Section 2. The Director of Public Property Administration, or his designee is hereby authorized to accept said property titles, in the form of the warranty deeds attached hereto as Exhibit D.

Section 3. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson requiring it.
