ORDINANCE NO. BL2009-577

An ordinance approving a lease between the Metropolitan Nashville Public Schools and the Simon Youth Foundation for space to be used for the Academy at Opry Mills Education Resource Center (Proposal No. 2009M-020PR-001).

WHEREAS, the Simon Youth Foundation, a non-profit corporation has committed to improving educational opportunities, career development, and life skills for at-risk youth across the country through the collaborative establishment of Education Resource Centers with local school systems

WHEREAS, The Metropolitan Nashville Public Schools has developed a lease agreement with the Simon Youth Foundation to utilize facilities at Opry Mills Mall to establish and operate an Adult High School program to be known as the Opry Mills Education Resource Center

WHEREAS, The Academy at Opry Mills provides a second chance for students who are unable to complete their education in the traditional setting because of family, work, or personal issues.

WHEREAS, The Academy at Opry Mills offers a wonderful opportunity to earn their high school diploma in an environment that meets their individual needs by offering a non-traditional school day and an opportunity to fast track their graduation.

WHEREAS, The Academy at Opry Mills offers students expanded opportunities for work experiences and college scholarships from an otherwise unavailable source.

WHEREAS, the Metropolitan Nashville Public Schools will not be charged rent for the use of the space utilized at Opry Mills

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this lease agreement be approved.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the lease agreement entered into between The Metropolitan Nashville Public Schools and the Simon Youth Foundation, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan County Mayor is authorized to execute the same.

Section 2: That any new amendments to this lease agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
