ORDINANCE NO. BL2009-552

An ordinance to amend various sections of Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, to permit adaptive reuse of commercial areas in the proposed Downtown Donelson Urban Design Overlay District, all of which is more particularly described herein (Proposal No. 2009Z-034TX-001).

WHEREAS, the Downtown Donelson Urban Design Overlay seeks to create a pedestrian-oriented neighborhood with daily services, amenities, and shops being located within walking distance of residences, thereby reducing traffic on local roads and interstates and in turn, improving the regional air quality by providing residential densities along a major transit corridor;

WHEREAS, the Downtown Donelson Urban Design Overlay boundary contains the Donelson Station Music City Star Station, and residential development within a 5-minute walk of a transit station has been shown to support ridership on public transportation;

WHEREAS, the existing commercial base zoning on the properties within the Downtown Donelson Urban Design Overlay expressly prohibits the vision for a mixed use community because it excludes residential uses; and

WHEREAS, this amendment will further the goal of creating a mixed use environment envisioned by the Urban Design Overlay, without changing the base zoning on properties within the Urban Design Overlay.

NOW, THEREFORE, BE IT ENACTED BY THE COUNTY OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 17.16.030 (E) of the Metropolitan Code is hereby amended by inserting after the phrase “adopted Major Street Plan,” and before the words “and where a minimum of forty percent”, the following phrase “or located within the Downtown Donelson Urban Design Overlay District”,

Section 2. That Section 17.16.030 (E) 10 of the Metropolitan Code is hereby amended by inserting after the phrase “procedures of Section 17.40.170 (A)” and before the words “and any supplemental information”, the following phrase, “or 17.40.170 (B), as applicable,”

Section 3. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
