ORDINANCE NO. BL2009-547

An ordinance amending Title 12 of the Metropolitan Code pertaining to the restriction of parking near fire hydrants.

WHEREAS, Section 12.40.040.A.2.b of the Metropolitan Code forbids the stopping, standing, or parking of a vehicle “within 15 feet of a fire hydrant”; and

WHEREAS, not all fire hydrants are located with immediate proximity to a street or sidewalk; and

WHEREAS, placement of fire hydrants that are set back from the roadside may impede fire truck and other emergency personnel access to such hydrants when cars park in front of hydrants that are more than 15 feet from the roadside; and

WHEREAS, an amendment of the language in the Metropolitan Code that regulates parking near fire hydrants will maintain clear access to fire hydrants by fire trucks and other emergency personnel; and

WHEREAS, such an amendment of the language in the Metropolitan Code of Laws is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 12.04 of the Metropolitan Code is hereby amended by adding the following new Section 12.04.103:

“Fire hydrant clear zone” means the area fifteen feet to either side of a line extending perpendicular from the roadway to the fire hydrant.

Section 2. That Section 12.40.040 of the Metropolitan Code is hereby amended by adding the following new subsection A.2.k.:

“k. Within a fire hydrant clear zone,”

Section 3. This Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
