ORDINANCE NO. BL2009-544

An ordinance authorizing the Metropolitan Government to participate with Patricia A. Wahl to provide public sewer service in Williamson County to Wahl Property, Project No. 08-SL-68.

WHEREAS, Pursuant to the terms of the document attached as Exhibit A, Patricia A. Wahl proposes to provide public sewer service in Williamson County, Tennessee, to a development known as Wahl Property, Project No. 08-SL-68; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Mill Creek Trunk Sewer Project No. 98-SG-13 anticipating participation from developers at $2,000.00 per connection towards the cost of the Project; and

WHEREAS, this Project is deemed to benefit both parties and the general community, and Patricia A. Wahl agrees to pay an amount not to exceed $6,000.00 for a total of 3 single-family home connections.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The participation agreement (Exhibit A) with Patricia A. Wahl, to provide public sewer services in Williamson County, Tennessee, known as Wahl Property, Project No. 08-SL-68, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

Section 2. That the $6,000.00 from Patricia A. Wahl will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No.47335.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
